This statement outlines the policies and practices of Optimum Building LLC, dba Optimum Coworking (“Optimum”, “we” or “us”) regarding the collection and use of our users’ personal information during your visit to www.optimumabq.com or any other websites owned or operated by Optimum Building LLC (the “Site” or “Sites”). By using the Sites or the services provided through this Site (the “Services”), you acknowledge that we may collect information about you, and use and disclose such information as described in this Privacy Policy. Your use of the Site or Services indicates your acceptance of the terms of this Privacy Policy.

Collecting and Personal Information Use
When you visit and navigate our sites and when you communicate with us via our sites, we will not collect personal information about you, such as your name, company name, e-mail address and telephone number, unless you provide us with that information voluntarily. This means that we will not know your Personal Information (defined as data that is unique to an individual or organization, such as a name, organization name, address, e-mail address, or telephone number) just because you browse our Sites unless you have provided it to us. In some cases, and in all cases where required by law or regulation, you will be able to update the information that you provide to us either by sending us an e-mail.
General Information Collected
To monitor site usage and improve the quality of our Sites, we gather general information about the use of our Sites. We use web server logs and industry-standard website statistics software to count the number of users who visit our Sites and to count the number of views of particular pages, as well as to track other general statistics about our Sites.
Automated Information
Using technologies that are widely used on the Internet, such as cookies, pixel tags, web beacons, and other technologies, we also may automatically collect information about your computer or mobile device and online activity when you access the Services. For example, we may collect your Internet Protocol (IP) address, your operating system, and browser type, as well as information about which pages you visit and the page, if any, that referred you to our Sites or that you visit our sites. Similarly, when you use our mobile applications, we may collect information about your mobile devices, such as the type of mobile device you use or your device identifier.
Most browsers have an option to reject or disable cookies, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. Although you can block cookies and similar technology, your experience of the Site and Services could be affected by doing so. Please be aware that this will disable all cookies delivered to your browser, not just the ones that we deliver.
Pixel tags are not visible to the user of the Site and consist of a few lines of computer code. Pixel tags are not used to collect any personally identifiable information about you. Our Sites use pixel tags to track the aggregate number of page views made on our Sites by all Site visitors. Our email service provider uses pixel tags to determine your ability to receive HTML-based email messages. This capability helps our service provider send email in a format you can read. The sensor does not collect or use any other information. Pixel tags also allow us to know how many users open an email and allow our service provider to compile aggregated statistics about an email campaign for us.
We also may use technologies called web beacons that communicate information from your Internet browser to a web server. Web beacons can be embedded in web pages, videos, or emails, and can allow a web server to read certain types of information from your browser, check whether you have viewed a particular web page or email message, and determine, among other things, the time and date on which you viewed the web beacon, the IP address of your computer, and the URL of the web page from which the web beacon was viewed. We use web beacons for a variety of purposes, including analyzing the use of the Services and in conjunction with cookies to provide content and ads that are more relevant to you. You may disable our web beacons in email messages by turning off images in your email client (e.g., Outlook, Outlook Express). Please see the instructions for your particular email client for more information. Please also be aware that by turning off images you may not be able to enjoy all of the Services as they were designed to be viewed.
Location Information
When you use the Services, we may collect information about your location separately from your address or other information that you provide to us explicitly. For instance, we may use the GPS feature of your mobile device or your IP address to help determine your geographic location. If you prefer that we not know your geographic location, you will have the option to disable the function when you first use the service in which we collect information about your location (or later, if your mobile device allows you to change the settings after initial download).
How We Respond to Do Not Track Signals
Do Not Track, or DNT is a concept that has been promoted by the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
Currently, various browsers (including Internet Explorer, Firefox, and Safari) offer a DNT option that relies on a technology known as a DNT header; this technology sends a signal to websites visited by the browser user about the user’s DNT preference. You can usually access your browser’s DNT option in your browser’s preferences. These browsers allow you to tell websites that you do not want to have your online activities tracked. These features are not yet uniform, so our systems may not recognize Do Not Track headers or signals from some or all browsers. Information Collected from Surveys
We may conduct online surveys via pop-up windows on our Sites. Participation in such surveys is voluntary and you may decline to participate. In general, the data collected in such surveys will be used by Optimum and not shared with any third parties.
Emails/Newsletters
We welcome your comments or questions about our websites and have provided e-mail boxes for that purpose. We will share your comments and questions with our customer service representatives and those employees most capable of addressing your questions and concerns.
It is our intention to only send you email communications that you want to receive. When you provide us with your email address, we will periodically contact you via email about Optimum programs and services. Every time you receive an email, you will be provided the choice to opt-out of future emails by following the instructions provided in the email. Please note that Optimum will never send you an email requesting your password, credit card number, social security number or other similar personal or private identification information. If you receive an email that looks like it is from Optimum, but asks you for personal information, it is a fraudulent email and you should not reply or provide such information.
Please note that your e-mail, like most, if not all, non-encrypted Internet e-mail communications, may be accessed and viewed by other Internet users, without your knowledge and permission, while in transit to us. For that reason, to protect your privacy, please do not use e-mail to communicate information to us that you consider confidential. If you wish, you may contact us instead via non-cellular telephone at the numbers provided at various locations on our sites.
Posting Information to Site
Please be aware that whenever you voluntarily post information to public areas on the Site or any other public forums, such information can be accessed by the public.
How We Use Your Information
We use the information that we collect about you for these purposes:

We also do research on our users’ demographics, interests, and behavior to help us operate our services, for other business purposes, and in connection with our display of advertising (which we describe below). This research is based on the information you provide to us including upon registration during a promotion, in surveys, and on your use of our services.
Disclosure of Information to Third Parties
Optimum uses the services of third parties, such as interactive marketing agencies, market researchers, and email service providers, to assist us with marketing and promoting our Sites. These parties are contractually prohibited from using personally identifiable information for any purpose other than for the purpose Optimum specifies. We do provide non-personally identifiable information to certain service providers for their use on an aggregated basis for the purpose of performing their contractual obligations to us. We do not permit the sale of Personal Information.
We also may disclose Personal Information in certain situations. You hereby consent to our sharing of Personal Information for the following purposes:
- To third party vendors who help us make the Site or Services available or who support our business
- To third parties to whom you ask us to send Personal Information
- At times Optimum may share with third parties aggregate, anonymous information about overall usage of our Sites and other Internet services that we collect, to provide general information about our Internet services, sell advertising, or establish sponsorships or other business relationships

Securing Your Information
The Personal Information you provide is encrypted and sent to us using a secure method. We treat personal information you provide as confidential information, and we use commercially reasonable security measures to protect personal information from unauthorized access, alteration, disclosure or destruction. After Personal Information reaches Optimum, it is stored on a secure server that resides behind firewalls designed to block unauthorized access.
However, please understand that no one can provide an absolute guarantee that information intended to be maintained as private, whether transmitted via the Internet or otherwise, cannot be accessed inappropriately or unlawfully by third parties. We have taken and will continue to take reasonable steps to ensure the secure and safe transmission of your personal information. You understand and agree that such steps do not guarantee that use of the Site is invulnerable to all security breaches and that Optimum makes no warranty, guarantee, or representation that use of any portion of our Site is protected from viruses, security threats or other vulnerabilities.
Personal Information of Children
By using the Site, you represent that you are at least 18 years old. The Site is not directed to children and children are not eligible to use our Services. We do not knowingly collect Personal Information from children under the age of 18. No part of the Site or Services is designed to attract people under 18 years old. If we later obtain actual knowledge that a user is under 18 years old, we will take steps to delete that user’s account and remove any of that user’s Personal Information from our databases.
Linking to Other Sites
From time to time, the Sites may provide links to other websites, not owned or controlled by Optimum, that we think might be useful or of interest to you. We cannot, however, be responsible for the privacy practices used by other website owners or the content or accuracy of those other websites. Links to various non-Optimum websites do not constitute or imply endorsement by Optimum of these websites, any products or services described on these sites, or of any other material contained in them.
Your California Privacy Rights
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are residents of the State of California in the United States to annually request and obtain, at no charge, information about the personal information (if any) we have disclosed to third parties for direct marketing purposes in the preceding calendar year. This information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. Optimum may change this statement from time to time; when updates are made, the privacy policy version date (located at the bottom of this policy) will also be updated to reflect that a revision occurred.
